The city of San Clemente isn’t happy with the company that’s been placed in charge of handling the local toll road, The Transportation Corridor Agencies (TCA.) While the city understands that the toll road is good for California’s financial situation, they feel that the way the agency is currently managing the project is in clear violation of the California Public Records Act.
The gist of the lawsuit is that TCA dedicated a great deal of time and finances to lobbying state legislatures and not enough time creating the toll roads it was hired to develop. The general consensus is that this has hurt San Clemente. The city hopes that by filing the lawsuit, it will force TCA to start taking action.
The lawsuit, which the San Clemente city council supports is sponsored by Rocky Chavez. No hearing date has been set. The city hopes that a judge will force TCA to release the records that they’ve maintained since taking over the Toll Road project so that everyone can see just how much money has been spent and what it’s been spent on. If the city wins the lawsuit, TCA will be required to pay the city’s legal bills.
The law requires that TCA respond within 10 days of the lawsuit being filed, though they are allowed to file for an extension if they show the court that it’s going to take a great deal of time and effort to gather the requested documents.
This is not the first lawsuit the city has filed against TCA. The two sides have spent the past 15 years engaged in a legal argument about another issue pertaining to the toll road. That battle recently ended when TCA signed the Save San Onofre Coalition protective agreement.
