What Is The Three Strikes Law In California?
In California, it used to be that any convict who committed any third felony would automatically be sentenced to 25 years+ prison time. This is the Three Strikes Law. However it was so disproportional in how it punished people for various non-violent to violent felonies. For example, one person could be sentenced longer for shoplifting than a person would be sentenced for murder. That’s rather unfair, as most would argue.
In 2012, this law was ratified with Proposition 36. Now, convicts whose all three felony convictions are serious and/ or violent are given the 25 years to life sentence. So, if their third conviction is not serious or violent, they could be exempt. (There are some exceptions, though).
In addition, inmates who were sentenced under the old Three Strikes Law may petition to have their jail time lowered.
